1. Agreement to these Terms

These Terms of Service govern your access to and use of the websites, games, educational tools, software, applications, content, and related services offered in connection with Torah Island and Torah Island Education (collectively, the “Service”). The Service is offered by Mark Me Media (“Mark Me Media,” “Torah Island,” “Torah Island Education,” “we,” “us,” or “our”). By accessing, browsing, creating an account, purchasing a subscription, or otherwise using any part of the Service, you agree to be bound by these Terms and by any policies incorporated into them, including our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users of the Service, including visitors, parents, guardians, family subscribers, teachers, school personnel, students, and any other person who accesses the Service.

2. About the Service

Torah Island and Torah Island Education are intended to provide educational, family, and game-based learning experiences. Features may include lessons, quizzes, interactive islands, progress systems, reward systems, subscription-based access, classroom or family management features, and other educational tools. Some features may be added, removed, limited, or changed over time.

3. Eligibility and authority to use the Service

You may use the Service only if you are legally able to enter into a binding agreement, or if you are using the Service under the supervision of a parent, guardian, school, or other authorized adult who accepts these Terms on your behalf. If you create an account for a child, student, classroom, or school organization, you represent that you have the authority to do so and to provide any related information to us.

Parents and guardians are responsible for supervising child use of the Service. Schools and teachers are responsible for ensuring that their use of the Service and their instructions to students are authorized and comply with applicable policies and laws.

4. Accounts, registration, and credentials

Some parts of the Service may require an account. When you register, you agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You must notify us promptly if you suspect unauthorized access, misuse, theft of credentials, or any security incident relating to your account. We may require you to verify your identity before restoring access or making changes to an account.

5. Parent-managed profiles and child use

Where the Service is offered for family use, child or player profiles may be created and managed through a parent or guardian account. The parent or guardian account holder is responsible for profile setup, device access, supervision, subscription management, and information entered into the Service. Parents and guardians should avoid placing unnecessary sensitive personal information into profile names, avatars, or user-submitted content.

Children may use the Service only as permitted by the parent or guardian account holder, or through a School or educational organization that has authorized such use.

6. School, classroom, and educational use

If the Service is used by or on behalf of a school, district, teacher, tutor, educational program, synagogue, camp, or similar organization, the organization is responsible for obtaining any permissions, consents, notices, or authorizations that may be required for student access and for providing accurate roster or account information. We may rely on the instructions of the School or authorized educator with respect to classroom administration, user access, and educational use of the Service.

Use of the Service in educational settings may also be subject to a separate written agreement, order form, or school subscription terms. If a separate signed agreement exists and conflicts with these public Terms, the signed agreement will control to the extent of that conflict.

7. License and permitted use

Subject to your compliance with these Terms, Mark Me Media grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for personal, family, school, classroom, or other permitted educational use. This license does not give you ownership of the Service or any content, software, or intellectual property.

9. User submissions, feedback, and communications

If you submit messages, feedback, suggestions, ideas, support requests, quiz responses, uploaded content, or other materials through the Service or to our team, you represent that you have the rights necessary to provide that material and that it does not violate law or the rights of others. You retain ownership of content you lawfully submit, but you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, adapt, and display that content as reasonably necessary to operate, maintain, improve, support, and provide the Service.

If you provide us with suggestions, feature requests, product ideas, or feedback, we may use them without restriction or compensation to you.

10. Subscriptions, billing, renewals, and cancellation

Some parts of the Service may be offered on a paid subscription basis. Pricing, taxes, billing intervals, included features, and plan options may vary. By purchasing a subscription, you authorize the applicable payment provider to charge the payment method you provide in accordance with the selected plan and any renewals.

Unless otherwise stated at the time of purchase, subscriptions may renew automatically at the end of each billing period until canceled. You are responsible for managing billing information and canceling a subscription before the applicable renewal deadline if you do not want the subscription to renew. Cancellation generally stops future renewals but does not automatically entitle you to a refund for a billing period already started, except where required by law or expressly stated by us.

We may offer complimentary accounts, scholarships, promo access, trial access, educator access, or manually managed subscriptions in some cases. Those may be subject to separate conditions communicated at the time of grant.

11. Free trials, promotions, and credits

From time to time, we may offer free trials, promotional pricing, discount codes, referral credits, classroom promos, or limited-time access. Eligibility for such offers is determined by us in our discretion. We may limit, modify, suspend, or terminate any trial or promotional offer at any time, consistent with applicable law. Unless otherwise stated, promotional credits have no cash value, are non-transferable, and may expire.

12. Refunds

Refunds, credits, and billing adjustments, if any, are handled according to the payment provider flow, our posted billing practices, and applicable law. Unless otherwise required by law or expressly stated by us in writing, fees may be non-refundable after the billing period begins. Certain app store purchases may be subject to the refund and cancellation procedures of the platform provider, rather than ours.

13. Third-party services and links

The Service may integrate with or link to third-party services such as authentication providers, hosting providers, analytics tools, payment processors, classroom tools, video platforms, support platforms, or app stores. We do not control and are not responsible for third-party services, content, privacy practices, billing systems, or terms of use. Your use of third-party services is governed by the terms and policies of those third parties.

14. App stores and platform providers

If you access the Service through a mobile app store or device platform, you acknowledge that the relevant platform provider may have additional terms, that the platform provider is not responsible for the Service itself, and that your use of the Service must also comply with any applicable platform rules. These Terms are between you and Mark Me Media, not between you and the platform provider, except to the extent platform rules give rights or impose obligations directly.

15. Educational content and service disclaimers

Torah Island and Torah Island Education are designed as educational and family learning resources. Although we aim to provide engaging, respectful, and useful content, we do not guarantee that all content will always be accurate, complete, current, uninterrupted, error-free, available in every region, or suitable for every learner, family, classroom, or religious standard. Educational content may evolve over time. Users remain responsible for how they use the Service and for reviewing whether it is appropriate for their needs.

16. Intellectual property

The Service, including software, code, game systems, visual design, text, branding, logos, islands, lessons, educational materials, graphics, audio, video, rewards systems, compilations, and other content provided by us, is owned by Mark Me Media, Torah Island, Torah Island Education, or our licensors and is protected by intellectual property and proprietary rights laws. These Terms do not transfer any ownership rights to you.

You may not use our trademarks, trade dress, logos, or branding without prior written permission, except for lawful nominative reference. Any unauthorized use of our intellectual property is strictly prohibited.

17. Copyright complaints

If you believe content on the Service infringes your copyright or other intellectual property rights, please send a notice with sufficient detail for us to identify the claimed material, the basis of your claim, and your contact information. We may remove or disable access to material alleged to be infringing and may terminate repeat infringers in appropriate circumstances.

Your use of the Service is also subject to our Privacy Policy. If the Service is used by children, families, or educational organizations, privacy practices may depend on whether the Service is being used directly by a family or under the direction of a School or educator. By using the Service, you acknowledge that we may collect, use, and share information as described in our Privacy Policy.

19. Availability, updates, and changes to the Service

We may modify, suspend, discontinue, restrict, or update any part of the Service at any time, including features, educational content, subscriptions, pricing, interfaces, reward systems, or supported devices. We may release updates, patches, bug fixes, or new versions automatically or require you to install them to continue using the Service. We are not obligated to maintain any particular feature, content library, compatibility standard, or level of availability for any specific period unless we expressly agree otherwise in writing.

20. Suspension and termination

We may suspend, restrict, or terminate access to the Service, accounts, profiles, subscriptions, or specific features at any time if we reasonably believe there has been misuse, fraud, nonpayment, security risk, a legal requirement, a violation of these Terms, infringement of rights, or conduct that could harm us, the Service, or other users. You may stop using the Service at any time. Where account deletion or cancellation tools are available, you may use them subject to any applicable billing, legal, or retention obligations.

Termination or suspension does not necessarily affect rights and obligations that by their nature should survive, including provisions relating to ownership, payments owed, disclaimers, limitations of liability, indemnification, dispute resolution, and applicable law.

21. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. Mark Me Media disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, reliability, and availability. We do not warrant that the Service will be uninterrupted, secure, error-free, or free from harmful components, or that defects will always be corrected.

22. Limitation of liability

To the maximum extent permitted by law, Mark Me Media, Torah Island, Torah Island Education, and our affiliates, officers, directors, employees, licensors, contractors, agents, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, or for loss of profits, revenue, data, goodwill, educational opportunity, subscriptions, or business interruption arising from or related to the Service, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Service will not exceed the greater of the amount you paid to us for the Service in the twelve months before the event giving rise to the claim or one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

23. Indemnification

You agree to defend, indemnify, and hold harmless Mark Me Media, Torah Island, Torah Island Education, and our affiliates, officers, directors, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, judgments, awards, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Service, your violation of these Terms, your violation of law, your infringement of rights, or content or information you submit or cause to be submitted through the Service.

24. Governing law and disputes

These Terms are governed by the laws selected by the business operating the Service, without regard to conflict-of-law principles, except where mandatory law requires otherwise. Before filing a formal claim, we encourage you to contact us first so we can attempt to resolve the issue informally.

If a dispute cannot be resolved informally, any claim will be brought in the courts having jurisdiction over Mark Me Media or as otherwise required by applicable law. If you are a consumer located in a place that gives you non-waivable rights to bring claims in your home jurisdiction, those rights are preserved to the extent required by law.

25. International use

The Service may be operated from the United States. If you access the Service from outside the United States, you are responsible for compliance with local law to the extent it applies. You understand that data may be processed and stored in the United States or other places where our providers operate, as described in our Privacy Policy.

26. Changes to these Terms

We may update these Terms from time to time. When we do, we may revise the effective date above and provide additional notice where appropriate. Your continued use of the Service after updated Terms become effective means you accept the revised Terms, to the extent permitted by law. If you do not agree to the revised Terms, you must stop using the Service.

27. Entire agreement, severability, and waiver

These Terms, together with any policies and documents expressly incorporated by reference and any applicable written subscription or school agreement, form the entire agreement between you and Mark Me Media regarding the Service, except where a separate signed agreement controls. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision or of any other rights.
