Mark Me Media LLC (hereafter called “Torah Island,” “Torah Island Education,” “Mark Me Media LLC,” “us,” “we,” or “our”) knows that you care how information about you is used and shared, and we appreciate your trust that we will do so carefully and sensibly. This Privacy Policy describes our collection and use of personal information collected from you through the online services, games, websites, and software provided on or in connection with Torah Island and Torah Island Education (collectively, the “Service”). “You” or “your” means a visitor or user of the Service, whether signed in or not. Your use of the Service is conditioned on your acceptance of this Policy.

A note about Student Data. This Service may be purchased or used by providers of educational services, such as schools, school districts, teachers, tutors, or similar educational organizations (collectively, “Schools”) that use our services for educational purposes. When Mark Me Media contracts with or provides the Service to a School, we may collect or have access to Student Data, which may be provided by the School or by the student. We consider such Student Data to be confidential and, in general, do not use such data for any purpose other than improving and providing our Services to the School or on the School’s behalf. Our collection, use, and sharing of Student Data is governed by our contracts with the School and applicable laws and regulations, including FERPA, COPPA, and applicable state laws where relevant. If you have questions about reviewing, modifying, or deleting personal information of a student, please contact your School directly.

We collect information in several ways from different parts of the Service.

Information you provide to us

Information we receive automatically from your use of our Service

Like most websites and online services, Mark Me Media and our vendors may automatically collect certain types of usage information when you visit the Service, read our emails, use our Service, or otherwise engage with us. Torah Island / Torah Island Education does not use Student Data for targeted advertising. We may use cookies, analytics tools, and similar technologies to understand how users engage with the Service, improve functionality, secure the Service, and measure traffic and usage trends.

If any general audience areas of the Service include third-party content, links, or tools, those third parties may collect information according to their own privacy policies. We encourage you to review those policies. Mark Me Media may, from time to time, send you email regarding our products and services or your use of them. You can choose not to receive promotional emails by clicking the unsubscribe link in any such email or by contacting us at the email listed below. Please note that you are not permitted to unsubscribe from non-promotional messages regarding your account, such as account verification, password resets, billing notices, changes or updates to features of the Service, or technical or security notices.

You may edit certain account information at any time by signing in to your account and updating your profile or settings where those controls are available. We recommend that you review your personal information periodically to ensure that it is accurate, complete, and current.

If you are a parent or guardian of a student who uses the Service through a School, please refer requests regarding access, modification, or deletion of your student’s account or Student Data to your School first. Schools may address such requests with us, and we will respond in accordance with applicable law and our agreements.

You may contact us for instructions about deleting or deactivating your account or deleting your personal information. We may not be able to comply with every request in all circumstances, such as where retention is required for legal, tax, security, billing, fraud-prevention, or legitimate business purposes.

7. How long do we retain your information?

We retain personal information for as long as needed to provide the Service and for internal business purposes that may extend beyond the termination or cancellation of your subscription or account. For example, we may retain certain data as necessary to prevent fraud, maintain records, comply with legal obligations, resolve disputes, or enforce our agreements. We may also retain and use information that has been de-identified or aggregated such that it can no longer reasonably identify an individual.

Student Data. We will not knowingly retain Student Data beyond the time period required to support an educational purpose, unless authorized by a School or parent or otherwise required by law. We may delete or de-identify personal information of student or child users after a period of inactivity, after termination of a license or subscription, or after the end of our agreement with a School, in accordance with applicable contracts and retention schedules. Some residual information may remain in backups, technical support records, customer service records, or similar business records for a limited period.

8. How do we protect your information?

The security of your personal information is very important to us. We use administrative, technical, and physical safeguards designed to preserve the integrity and security of the personal information we collect and to protect against unauthorized access, use, or disclosure. These measures may include access controls, authentication systems, encrypted transmissions where appropriate, internal reviews of our data collection and storage practices, logging, and vendor security controls.

However, no security system is impenetrable, and we cannot guarantee the absolute security of your information. Maintaining the security of your personal information also requires your cooperation. Please keep your password secure, sign out from shared devices, and do not use account “remember me” features on public or shared computers.

Information collected through the Service may be stored and processed in the United States or other countries where Mark Me Media or its service providers maintain facilities.

Notice for California Residents

If you are a California resident, you may have rights under California privacy laws, including rights to know, access, correct, delete, and request information about how personal information is used or disclosed, subject to applicable exceptions. Please note that Student Data processed on behalf of Schools may be subject to separate rules and school-directed procedures.

Notice for Nevada Residents

Nevada residents may have certain rights under applicable Nevada law regarding certain disclosures of covered information.

Notice for Residents in the European Economic Area or similar regions

Where applicable, we rely on legal bases such as performance of a contract, consent, compliance with legal obligations, and legitimate interests to process personal information. Users in such regions may have rights of access, portability, rectification, erasure, restriction, and objection, subject to applicable law.

10. How do we protect children’s privacy?

Torah Island / Torah Island Education does not knowingly permit children to create independent accounts where parental or school authorization is required by law. If the Service is used directly by families, children under 13 should use the Service only with the consent and involvement of a parent or legal guardian. Parents who purchase or manage access to the Service may set up child profiles associated with the parent account so that children may access the Service under the parent’s supervision.

When the Service is used by a School in an educational setting, the School may authorize us to collect information from a child under 13 as permitted by law and for educational purposes. If you believe we have inadvertently collected information from a child in a way not permitted by law, please contact us so that we may investigate and take appropriate action.

11. How do we protect Student Data and comply with laws?

When Mark Me Media provides the Service to Schools, our collection, use, and disclosure of Student Data is governed by our Terms of Service and/or any agreement with the School, along with applicable laws such as FERPA, COPPA, and relevant student privacy laws.

FERPA. This Privacy Policy and our Service are intended to support Schools in protecting education records and related personal information in accordance with FERPA where applicable.

COPPA. We do not knowingly collect personal information from a child under 13 unless and until a parent or School has authorized such collection as permitted by law. When a School uses our Service in an educational setting, we may rely on the School to provide appropriate authorization where permitted.

State student privacy laws. To the extent applicable, we seek to align our practices with state student privacy requirements, including restrictions on targeted advertising, sale of Student Data, and unauthorized profile-building.

The Service may contain links to and from third-party websites, payment portals, authentication providers, app stores, educational resources, or other services. If you follow a link to any third-party website or service, please note that those sites and services have their own privacy policies and practices. We are not responsible for the privacy practices or content of third-party services.

Mark Me Media may modify or update this Privacy Policy from time to time, which will be reflected in the “Last Updated” date above. If we change this Policy in a material manner, we may notify users by posting a notice on our website, through the Service, by email, or through another appropriate communication channel. Your continued use of the Service following the effective date of an updated Policy constitutes your acceptance of the revised Policy to the extent permitted by law.
